These Terms of Use (hereinafter referred to as the "Agreement") govern the relationship between the Operator — an individual, Danil Kamyshansky (hereinafter referred to as the "Operator") and any person (hereinafter referred to as the "User") using the website pogoda.ru and the mobile applications "Pogoda.ru — Weather Forecast" (collectively referred to as the "Services").
By accessing or using the Services, the User fully accepts the terms of this Agreement.
1. General Provisions
1.1. The Services provide Users with access to current weather data, forecasts, notifications, weather maps, and related information.
1.2. The Services are intended for personal, non-commercial use only.
1.3. All rights to the Services, including the domain name, source code, design, logos, and content, belong to the Operator or to their respective legal owners.
2. Use of the Services
2.1. The User agrees: To use the Services only for lawful purposes; Not to interfere with the proper functioning or security of the Services; Not to post false, offensive, or harmful content; Not to use automated tools (bots, scripts, etc.) to access the Services without written permission.
2.2. The Operator reserves the right to restrict or terminate a User's access to the Services in case of a violation of these Terms.
3. Information and Disclaimer
3.1. All forecasts and weather data provided via the Services are for informational purposes only and are not guaranteed to be accurate.
3.2. The Operator shall not be held liable for any damages resulting from the use of information provided by the Services.
4. Personal Data
4.1. By using the Services, the User consents to the collection and processing of their personal data, in accordance with the Privacy Policy , including geolocation data, device identifiers, cookies, and analytics.
4.2. Personal data is processed in accordance with Russian Federation Federal Law No. 152-FZ "On Personal Data."
5. Advertising and Third-Party Services
5.1. The Services may display advertisements provided by third parties (e.g., through Yandex Ads SDK).
5.2. For advertising and analytics purposes, the Services use third-party platforms such as Firebase, Google Analytics, and Yandex.Metrica.
5.3. The User understands that use of the Services involves interaction with such third-party systems according to their respective privacy policies.
6. Geolocation and Push Notifications
6.1. The Services may request access to the User's device location solely for the purpose of displaying localized weather forecasts.
6.2. Notifications are sent via Firebase Cloud Messaging and can be disabled by the User in device settings.
7. Limitation of Liability
7.1. The Services are provided "as is." The Operator makes no warranties regarding the availability, accuracy, or error-free operation of the Services.
7.2. The Operator shall not be liable for:
The unavailability of the Services due to external circumstances; Any losses incurred by the User as a result of using the information provided; Actions of third-party services (advertising, analytics, hosting).
8. Changes to the Agreement
8.1. The Operator reserves the right to amend this Agreement at any time without prior notice.
8.2. The current version of the Agreement is always available at pogoda.ru and within the mobile apps.
9. Governing Law
9.1. This Agreement shall be governed by and interpreted in accordance with the laws of the Russian Federation.
9.2. All disputes shall be resolved in accordance with applicable Russian law.
